I can't comment on EU law but the ability to redistribute the (modified) code is also a defining characteristic of open source http://en.wikipedia.org/wiki/Open_source

Yes, but reverse engineered code is NOT subject to copyright of the original author by law (there is an EuGH decision about this). IANAL.

Therefore it is, essentially, open source.
